Item 2.  KENTUCKY FRIED CHICKEN/A&W DRIVE-THROUGH RESTAURANT - 37123 and 37149 FREMONT BOULEVARD - (PLN2007-00152) - to consider a Conditional Use Permit for the establishment of an approximately 3,000 square-foot drive-through restaurant and a 1,500 square foot commercial building on one recently-merged parcel in the Centerville Planning Area.  This project is categorically exempt per California Environmental Quality Act (CEQA) Guideline 15302 reconstruction of a commercial facility.

PLN2007-00152 KFC/A&W Drive Through Restaurant

Item 3.  PACIFIC COMMONS DEVELOPMENT AGREEMENT ANNUAL REVIEW - (PLN2008-00083) - to consider a City Manager's report on the annual review of the Development Agreement for property generally located westerly of Interstate 880 between Auto Mall Parkway and Cushing Parkway in the Industrial Planning Area.  An EIR and Supplemental EIR ("SEIR") were previously approved for the Pacific Commons project.  An Addendum to the SEIR was prepared and adopted for the Planned District Major Amendment (PLN2003-00166) finding the project to be consistent with the original plan and environmental documents.  This review of the Development Agreement is not a project as defined in the CEQA Guidelines Section 15378.

PLN2008-00083 Pacific Commons Development Agreement Annual Review

Item 5.  2007 ANNUAL RESIDENTIAL  CONDOMINIUM CONVERSION REQUESTS - 38200 LOGAN DRIVE and 43551 MISSION BOULEVARD - (PLN2007-00274 and PLN2006-00233) - to consider the Annual Residential Condominium Conversion requests for two timely-filed applications totaling 47 dwelling units accepted for the calendar year of 2007.  The proposed project descriptions for the two sites are as follows:

1.              Logan Park38200 Logan Drive - (PLN2007-00274) - to consider a Conditional Use Permit to allow a 36-unit residential condominium conversion for individual ownership of units within an existing multiple-unit development located in the Centerville Planning Area.  Building and site improvements are proposed to improve aesthetics and for compliance with the condominium conversion ordinance (e.g., restoration and repair of building, enhancement of landscape and open space areas, hardscape improvements, among others).  This project is categorically exempt per CEQA Guideline 15301, Existing Facilities.

2.              Old School - 43551 Mission Boulevard – (PLN2006-00233) – to consider a Conditional Use Permit to allow an 11-unit live-work residential condominium conversion for individual ownership of units within an existing multiple-unit mixed-use development located in the Mission San Jose Planning Area. Minor building improvements (e.g., trash enclosure) are proposed for compliance with the condominium conversion ordinance.  This project is categorically exempt per CEQA Guideline 15301, Existing Facilities

Item 7.  TRI-CITIES SOCIETY OF MODEL ENGINEERS TEMPORARY RELOCATION - 3723 DARWIN DRIVE - (PLN2008-00116) to consider a Conditional Use Permit to allow a private non-profit membership organization to temporarily occupy a former fire station located in Planned District P-69-7 and Planned Unit Development PUD-70-3 in the Northern Plain Planning Area.  This project is categorically exempt pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15303, conversion to new use

PLN2006-00182 Foster Residence Addition

Item 4.  CITYWIDE HIGH INTENSITY HAZARDOUS MATERIALS ZONING TEXT AMENDMENT AND AUTO MALL PARKWAY CORRIDOR GPA & PD - (PLN2005-00307 & PLN2008-00122) - to consider a Citywide Zoning Text Amendment which would modify the approval process as it relates to the Light, Restricted and General Industrial Zoning districts depending on the type and amount of hazardous materials.  The second part of the project is to consider a General Plan Amendment from General Industrial - Commercial Overlay to Light Industrial and a rezoning from S-2005-307 to a New Planned District (P-2008-122) which would allow Light Industrial land uses and a variety of assembly type uses, to locate on lands adjacent to Auto Mall Parkway, from the intersection of Fremont Boulevard to I-880 in the Industrial Planning Area.  The final part of the project would see the area between the Union Pacific Railroad tracks and Fremont Boulevard adjacent to Auto Mall Parkway rezoned from S-2005-307 to General Industrial, which the area was originally zoned prior to the Interim Study District Zoning being implemented in 2005.  A Negative Declaration has been prepared and circulated for this project.

Citywide High Intensity Hazardous Materials ZTA & Automall Parkway Corridor GPA & PD

Item 6.  PEDESTRIAN MASTER PLAN GENERAL AMENDMENT - CITYWIDE - (PLN2008-00016) - to consider adoption of the Pedestrian Master Plan and a General Plan Amendment to amend Chapter 8 (Transportation Chapter) of the Fremont General Plan consistent with the Pedestrian Master Plan.  A Negative Declaration has been prepared and circulated for this project.
