New Requirements

For New and Redevelopment Sites

The National Pollutant Discharge Elimination System Permit (NPDES or Stormwater Permit) issued by the San Francisco Bay Regional Water Quality Control Board (Water Board) mandates programs to prevent stormwater pollution. 
 
The stormwater permit contains a number of requirements to manage stormwater runoff at development projects including:

Detail

Impervious Surface Area, Stormwater Treatment and Hydromodification Management Measures Form
  • Required for all development projects on lots greater than or equal to 10,000 square feet.
  • Must be submitted to the City prior to the issuance of permits.
Stormwater Treatment Measures with hydraulic sizing
  • Applies to new and redevelopment projects that create or replace 10,000 square feet or more of impervious surface area (roof, streets, sidewalks, parking lots, etc).
  • Projects must incorporate stormwater treatment measures and size according to hydraulic standards.
Hydromodification Management (HM) Standard
  • New and redevelopment projects that create or replace 1 acre or more of impervious surface area must control the quantity of stormwater runoff in areas where increased runoff flow and volume may cause increased creek erosion.
  • Options to control stormwater quantity include: detention basins, wet ponds & underground devices.

 

Stormwater Treatment Measure Maintenance Agreement aka Operations and Maintenance Agreement 

(O&M Agreement)

  • Required for all projects incorporating stormwater treatment measures and/or hydromodification management measures to ensure adequate maintenance.
  • Agreement executed between the City of Fremont and property owner of development site.
  • Agreement recorded on property title.

Site Design Measures

 

  • Design measures to maximize pervious areas and increase infiltration such as disconnected roof leaders, pervious paving, clustering building to maintain open space, and green roofs.
Source Control Measures
  • Operational/facility measures used to reduce water quality impacts including: Roofed trash enclosure, indoor mat/equipment wash racks, designated vehicle wash area that drains to sanitary sewer.
