At its June 27 Council meeting, the Fremont City Council voted to place a citizen sponsored initiative titled "Initiative to Change the Open Space and Restricted Industrial General Plan Designations for a Portion of Fremont's Northern Plain Planning Area to Agriculture" on the November 7, 2006 ballot for Fremont voters to consider.
The California State Elections Code provides that written ballot arguments may be submitted both in favor of, and against, a ballot measure. Arguments may be submitted by the City Council; the individual voter or bona fide association or citizens, or combination of voters and associations, who are the bona fide sponsors or proponents of the measure; bona fide associations of citizens; or individual voters who are eligible to vote on the measure.
The Fremont City Council has chosen not to participate in the written ballot arguments on the Northern Plain Planning Area Initiative.
The California State Elections Code also provides that the Elections Official (City Clerk) shall fix a date for the written ballot arguments to be submitted. In order to provide an appropriate amount of time to review and make copies of the arguments available for public review as required, the Fremont Elections Official has fixed the following deadlines for the submittal of written ballot arguments on the Northern Plain Planning Area Initiative:
- Primary Arguments due to the Fremont City Clerk's Office: by 5:00 p.m. Friday August 11, 2006
- Rebuttal Arguments due to the Fremont City Clerk's Office: by 5:00 p.m. Monday August 21, 2006
The Primary Argument may be no longer than 300 words in length and may include no more than five (5) signatures. The Rebuttal Argument may be no longer than 250 words in length and may include no more than five (5) signatures.
