This section is limited to Incident Report requests. If you are seeking a copy of Pre-Hospital Patient Care Report, please scroll to the section below for the process.

Pre-Hospital Patient Care records are protected by Health Insurance Portability and Accountability Act (HIPAA) and cannot be requested through the City's Public Records website.

Request Process

If the requestor is the person involved in the incident:

• Complete the Authorization for Release of Patient Care Records form.
• Email completed form to Fremont Fire Department Attn: Custodian of Pre-Hospital Patient Care Records.  
• If the requestor is the person involved in the incident, no supporting documents are needed.
• You will be notified if the Incident Report and the Pre-Hospital Patient Care Report have been identified and processed for release or if we are unable to locate the record.
• The record will be released as noted in the Authorization form.

If the requestor is a third party (not the person involved in the incident): 

• Complete the Authorization for Release of Patient Care Records form.
• Email completed form to Fremont Fire Department Attn: Custodian of Pre-Hospital Patient Care Records. 
• Provide HIPAA compliant supporting documentation. This legally allows the Fire Department to release the Patient Care Report to a third party.
• You will be notified if the Incident Report and the Pre-Hospital Patient Care Report have been identified and processed for release or if we are unable to locate the record.
• The record will be released as noted in the Authorization form.

Or Submit a Subpoena Request for Pre-Hospital Patient Care Records

• Issue a Subpoena Request to Fremont Fire Department via the City Clerk's office.
• Include a Subpoena Check in the amount of $15.00 (fees for production of records) addressed to the City of Fremont.
• Subpoenas can be hand-delivered or sent via postal mail. We cannot accept email requests.
• If you are hand-delivering your subpoena, email the City Clerk's Office to schedule a delivery appointment.

To request a member of the Fremont Fire Department to appear at a deposition, trial, legal hearing, testimony, etc., please follow the process below:

• Subpoena Requests for personnel appearance must be hand delivered to the Custodian of Records, Fremont Fire Department. We cannot accept email requests.

• Include the applicable witness fees check in the amount of $275.00 per person per day (civil cases) made payable to the City of Fremont and submit along with the Subpoena Request. This amount is a deposit against the actual costs incurred by the City in complying with the Subpoena. Issue one check per employee requested.

• Issue a Subpoena Request to the Fremont Fire Department with the name of the employee whose presence is being requested. Submit one Subpoena Request per employee requested.

• To avoid delays and ensure efficiency, include location, date, and time of the incident associated with your request.
